Last Updated: September 1, 2026
This Digital Millennium Copyright Act (DMCA) Policy outlines how McCord Financial Consulting LLC (hereinafter "Platform," "we," "our") responds to notices of alleged copyright infringement. We respect intellectual property rights and expect our users to do the same.
1. Notice of Copyright Infringement
If you believe that material posted on the Platform infringes upon your copyright, you may submit a formal notification to our designated agent. For the notice to be considered valid, it must include the following information:
a) Physical or Electronic Signature — The signature of a person authorized to act on behalf of the copyright owner.
b) Identification of the Protected Work — A description of the copyrighted work that you claim has been infringed. If the notice covers multiple works, a representative list may be provided.
c) Identification of the Infringing Material — A description of the material that you claim is infringing, along with information allowing us to locate it on the Platform (e.g., URL or specific description).
d) Contact Information — Your first name, last name, address, phone number, and email address so that we may contact you.
e) Statement of Good Faith — A statement that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law.
f) Statement of Accuracy — A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
2. How to Submit a Notice
Please send notices of alleged copyright infringement to our designated DMCA agent at the following contacts:
Email: [email protected]
Mailing Address: 928 11th Street, Unit 3, Santa Monica, CA 90403, USA
Phone: +1 (310) 555-0198
We highly recommend submitting notifications via email, as this ensures the fastest response.
3. Our Response Procedure
Upon receiving a valid DMCA notification, we will take the following actions:
3.1. Content Removal. We will expeditiously remove or disable access to the material that is alleged to be infringing.
3.2. User Notification. We will notify the user who posted the disputed content (if applicable) regarding the received notice and the removal of the material.
3.3. Monitoring Repeat Offenders. We track instances of repeat infringement and may, when justified, terminate the accounts of such users.
4. Counter-Notice Procedure
If you believe that your content was removed by mistake or misidentification, you may submit a counter-notice to our support team using the same contact information provided in Section 2.
A valid counter-notice must include your physical or electronic signature, identification of the removed material and its former location, a statement under penalty of perjury that the material was removed by mistake, your contact information, and your consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Santa Monica, California, if your address is outside the United States).
4.1. Restoration of Content
Upon receiving a valid counter-notice, we will forward it to the person who submitted the original notification. If we do not receive notice within 10 to 14 business days that a court action has been filed seeking a court order to restrain you from engaging in infringing activity related to the material on our Platform, we may restore the removed content.
5. Repeat Infringer Policy
McCord Financial Consulting LLC maintains a strict policy against repeat infringement. Users whose accounts are subject to multiple valid copyright infringement notices may face the following consequences:
| Number of Infringements | Potential Consequences |
|---|---|
| First Infringement | Content removal and formal warning |
| Second Infringement | Temporary account restriction |
| Third and Subsequent | Account suspension or permanent ban |
Each case is evaluated individually, considering specific circumstances.
6. Fair Use Exceptions
Please note that not every use of a copyrighted work constitutes infringement. Before submitting a notice, consider whether the disputed content might qualify as fair use or another legal exception, including use for commentary, criticism, news reporting, teaching, or research.
Notices submitted with knowingly false claims of infringement may result in legal liability and damages under Section 512(f) of the DMCA.
7. Limitation of Liability
The Platform acts as an intermediary and is not liable for content posted by users. We cannot verify the legality of every piece of content posted; however, we are committed to responding swiftly to valid DMCA notices and cooperating to protect the interests of copyright owners.
8. Policy Modifications
We reserve the right to modify this policy at any time. We will notify users of significant changes by posting an update on the Platform. Continued use of the Platform after the publication of changes constitutes your acceptance of the updated policy.
